Not all beating up is nearly killing. Good enough shot and they'd most likely just give up. So it's actually downgraded to third degree assault which is only about 2 years, if the judge even sends you to prison.

Beating up is not the same thing as nearly killing. You'd get battery, not attempted homicide. And you'd probably get bailed out by your new girl.
