The "with the driver still in the car" doesn't really do anything in this post, I don't think .-

yeah its irrelevant whether or not the driver is in the car. Illegal parking is illegal parking.

It's still the duty of the driver to see that illegally parked car. Unless the car was parked in the middle of the road just past a blind curve, I say No Way
