Law enforcement is forbidden from searching illegally. With this rule in place, they know that whatever they find, if not found legally, will be of no use. Therefore, they won't do it. If they could use the evidence, then many police officers might use it as excuse to exploit suspects. They could break into a house of someone they dislike and search it under the pretext of "searching for evidence" and then if they happen to stumble across something they could use it. The law is to protect civilians from the government.

It's not that police should be able to obtain evidence illegally, because they shouldn't, but if they do it shouldn't be thrown out. Instead a separate case against the officer should be made with severe consequences to deter similar actions, because let's face it, both people broke the law an should be held accountable, not kne let free because someone else also broke it

You can't break the law to make some one else pay for breaking the law. It's called due process, and everyone gets it. Using illegally-obtained evidence would be directly going against the Bill of Rights. Everyone is innocent until proven guilty, so if you illegally obtained evidence, you have wronged an innocent person, and in that case the police officer or investigator should go to jail.

How the hell does this have a positive vote? That really shows a lack of understanding of criminal law. There have been an UNCOUNTABLE number of Supreme Court Cases that time and time again have determined why this is Unconstitutional. Look at Mapp V OH or Miranda v AZ before you make stupid fucking ignorant posts like this. I swear, America gets dumber every day.
