No... if the man is stupid enough to hang around a habitual smoker, then they deserve to die. If they can't move, they should say something to the smoker.

Pretty harsh. What if it was a small child and their parents smoked? They wouldn't know to ask their parents to stop, and they wouldn't know or be able to leave.

Most likely the effects of secondhand smoke wouldn't affect the child that quickly anyway so by the time they died they would most likely be an adult

MAYBE if it was a small child that had no choice, but honestly, you'd have to keep it locked in a room with 20 cigarettes at a time for 23 hours a day to die from it.

I agree to an extent. This should only apply to minors who can't legally get away from secondhand smoke if their parents smoke. Otherwise, people who choose to hang out with smokers suffer the consequences of their own actions.

You'd have to be able to prove which person supplied the second hand smoke that killed. Example: woman cheats on her man who smokes, with a man who smokes. Which person's smoke did it? And, what if no one knew she was cheating, and her man (who always went outside to smoke) was prosecuted?

This. I've lived with heaps of people, rented a bunch of places, stayed over people's house for days, etc., and the majority of the people I lived with smoked. If I died tomorrow from second hand smoke (ignoring the fact that I gave up only two months ago) who are you gonna charge - the people I'm currently living with, or give every smoker I've ever stayed with a $50 fine?

I agree, but it should apply to children, especially babies and toddlers who can't even say that they can't breathe.
