+47 An action should be judged by what could have been predicted as a result of it at the time conducted, not in the future once the possible unforeseeable consequences are revealed, amirite?

I'm not sure I'm with you on this...it seems you're saying we should use hindsight to allocate blame based on what we assume the parties should have been able to predict at the time...that sounds dangerous to me. Doesn't sound fair, democratic or reasonable at all. Who will decide the standards of what "could have been" predicted? Aren't you just advocating a new kind of hindsight? How is that helpful at all?
