Personally, I think they need to eliminate the whole "hate crime" joke. A crime is a crime, no matter who commits it or who the victim is. Creating a "hate crime" penalty just tells people that some lives are more valuable than others. Commit a crime against a white and you get 2 years. commit it on a protected class, under it being labeled a hate crime, gets you 10 to 20.
No it should just be prosecuted as a crime.
Ok faceman. If a white person violently assaults a black man, just for being black.. does the law then apply?
The law of not assaulting people? Then yes. Hate crime law? Then no.
I'm not a fan of hate crime laws, since all violent crime could be said to be based in hate. Plus it tends to be very one-sided in its application.
So the whole concept of "Hate Crimes" should not exist? All I ask is should they exist for both? Or neither?
Neither. If the penalty for assaulting someone is 2 years, why should it be 10 years if a minority or protected class is the victim? Punishment should be equal for ALL.
I agree, let's spread the law around. Equal law for all.
Neither. The notion of "hate crimes" laws actually raises one group above another.
I'm good with it not being applyed to anybody. Though if one.. let's make it apply to all.
I agree with you. But they won't. Thererefore what is good for the goose...
The issue I see is people not liking the "hate crime" definition. I don't see the problem. It doesn't stop being a crime. They simply put more labels on it.
I also believe teens. 15 to 17 should not be devoid of prosecution in "Hate Crime Attacks"
If you're going to have hate crime laws, they need to be applied evenly to everyone. If not, the law it's self is a form of discrimination and abuse.
As long as we have "hate crime" charges, of course they should. Although it's not as common, black people ARE charged with hate crimes.
Yes, though on an equal standard?
I do not know.
If *a person attacks another only based on race, that's a hate crime, period.
Yup. And the number of black on white, vs White on black has been quite substantial this year. Should leave Hate Crime prosecution up to the circumstance.
No Sofia. It's just a crime. Many crimes involve hate. I could hit a man in a bar because he made a comment about my wife, and I hated it. Should that be a hate crime? If a person attacks someone because they support a particular candidate, and both are the same color, is that a hate crime? Now, if you have the same situation, but the two are different color, should that be a hate crime?
I Race has no bearing when it comes to committing and being convicted of a crime. Give me an example of ANY assault case and tell me it wasn't related to hate. Why should there be special, more harsh sentences for a white than a minority?
If three neo nazi white guys drag a black guy behind a truck and hang him from a tree, should that be held to a different standard? If three black power guys drag a white guy behind a truck and then hang him from a tree.. should that be held as a separate standard?I think it should be treated the same.
If something called the "Knock out Game" occurs where black men knock out random white people for fun and "points".if It is video taped and put online. And one of the "players" has the gall to say "Damn! White girl bleed A lot!" While laughing.. still no?
I know it's a crime. Just because the system puts more labels on it, it doesn't stop being a crime. The thing is I don't have a problem with those labels. So, actually, it's still a yes for me.
"Why should there be special, more harsh sentences for a white than a minority?" - okay, I''m sorry, but where does that come from? Since when is hate crimes equal to more harsh sentence for a white than a minority? For what I'm aware hate crime is a crime motivated by racial, sexual, or other prejudice, typically one involving violence. In the cases of racism, it doesn't matter if you're white, black, asian, the sentence is the same. If the state you live in has harsher punishments for one race than the others, then that's another issue.
Sophia, How many blacks have been charged with a hate crime on a white?
"Since when is hate crimes equal to more harsh sentence for a white than a minority?"
Since 99.9% of hate crime charges are levied against whites, for the same crimes that are perpetrated on whites with no hate crime charge, the sentences are harsher against whites for committing the same crimes minorities commit.
Look at DW2's comment above.
Like I said - If the state(or country) you live in has harsher punishments for one race than the others, then that's another issue. That's called racism. That doesn't mean "hate crimes" shouldn't exist or that they are the issue. The people misusing it are the issue. If you use the law properly, you'll see it's not that problematic.
Since when can w expect the government to use the law fairly? If I hit a person, for ANY reason, I should get the same punishment if its a white guy or a black guy. When you start getting into lawyers and courts deciding what I was thinking at the time, it all goes to hell. Then you get the guy I hit claiming I hit him because he was black, not because he grabbed my wifes butt.
Hitting someone because of their skin colour and hitting someone because they pissed you off are two very different things. Because on one side, you have a problem with that particular person, on the other, you are a danger to all people of that skin colour. So reason does matter. And that's why there's investigations, they'll investigate your life and so on, and they will conclude if you're lying or not. Will they always get the correct conclusion? No. Cops are still people. How many innocent people are jailed? Probably more than people think.
Sophia, THAT was my point. A black will NOT be charged with a hate crime for hitting me solely because I am white. That is just a fact. Remember the knockout "game". Who was targeted? Whites. There was not one charge of a hate crime.
If you think what I said is the same as you're saying, then one of us is reading something wrong. I'm saying the problem is the people, not the law. The law makes sense. The law should stay as it is. It's the people using it that need to change. A hate crime should be labelled as such, and I gave an example of why. If it's done by whites, blacks, whatever there is, it should be labelled as such and the punishment should be proper for the crime.
There has been cases of blacks being charged with hate crimes against whites. Just the most recent, the 4 Chicago Teens against the white disabled boy.
The country still has long ways to go, but a black can be charged with hate crime if he hits a white for being white.
if that is the reason
While I dislike labelling, I'm sure it would be labeled like that if it was the other way around.
And it is.
A crime is a crime. Everyone, even celebrities, politicians and wealthy people need to be prosecuted the same way.
If not we don't have to follow the laws. So-called "hate crimes" are really thought crimes.
That they are.
Anyone who attacks another is hating so it is always a hate crime.
