In every State that has the death penalty, anytime a defendant on death row is found guilty again of the same crimes in a retrial, the judge/jury should be permitted by law to keep the defendant on death row. So that a retrial if granted, would not be an advantage for the inmate to automatically get off death row, regardless to being found guilty again of the same crimes. Amirite?
