My kid chokes on ham every time he eats it. He's a chewer, he just doesn't think he needs to chew ham specifically for some reason.

Steak is sometimes a bit tough, especially when it's cooked in a pan so I always make sure to cut it for him. The ham thing is just user error because I know he can do it, he just doesn't.

I mean, all of those things are served in the schools cafeteria. Bag lunches for field trips when I was younger were hotdogs with small packages of condiments, chips, some type of fruit, and a sweet. All of those things could be choked on, you just need to be paying attention.

Because you're picking out one tiny example of thousands of things that can be considered choking hazards to children and then further narrowing it down by making it a specific type of that thing (food >> candy >> hard candy) Monitoring your children is leaps and bounds the superior method of ensuring child safety, not trying to pick out one very specific thing from a list of items, many of which a child is more likely to choke on.

Most choking deaths are in infants and toddlers. An age minimum of twelve is crazy. And hard candies aren't that much more likely to cause choking than other foods.

So are hot dogs. Hot dogs are probably much more of a hazard to toddlers because, unlike a jolly rancher, hot dog meat can get compacted easily to fit the unique shape of the child's esophagus.

Roughly 5000 people die each year from choking in the USA. Children under 5 are at a higher risk, but how many children under 5 are in school? Most kids in school are 5 and older. Yeah, there are preschoolers, but not every child goes to preschool. But out of that 5000 who die, 140 are children. 140, out of approximately 37,000,000 kids under the age of 12. You're going to get rid of Jolly Ranchers because a child has a 1-in-264000 chance of choking to death? Bear in mind, not all, maybe not even most of the 140 choking deaths are due to hard candies, so the probability of dying from them is even lower. You want to know what kills more children under the age of 12? Car accidents. Over 700 each year. Another 70 kids under the age of 5 are killed as pedestrians. You want to get rid of cars? These are just the numbers.

I honestly agree with the sentiment, choking is usually caused by things being swallowed before they can be properly chewed, easy to do when you cant physically chew the thing. I only disagree with your whole argument on the premise that we don't need law involved for every single social change. Always get's too many hands on it each with their own agenda.

Yeah I choked on a jolly rancher when I was 4 and legit almost died. It gave me a severe phobia on swallowing anything not chewable including prescription pills. I'm 31 and still have trouble swallowing pills :(

When my daughter was little, people would constantly offer her hard candy. I always intervened and told them it was too risky. Most were seriously offended. As she got older, I explained to her that hard candy could hurt her. She started calling it "hurt candy" and wouldn't accept it.
