Well actually they just choose the highest percent without saying 100 because they don't want to get sued if someone get's sick or if a new germ is found.

That .01% that's immune to the sanitizer is going reproduce and create more germs immune to the sanitizer, eventually turning that 99.99% into 10%.

Actually, it's .01% of /all/ germs, not just part of one germ.
But, that claim was made from carefully controlled laboratory settings, so it's very likely that in practical situations, hand sanitizer doesn't kill that many germs.
