+59 We have the right to free speech, so technically, when a teacher gives you detention for swearing at them, they are violating your human rights. amirite?

The thing about the right to free speech is that it has its limitations. For instance, it doesn't cover cussing. Also, we've all heard of the guy who yelled "FIRE!!!" in a crowded theater and got arrested, then tried to cover it up by saying he was covered by free speech. The Supreme Court stated that the 1st Amendment does not protect the right to hurt others with words. Apparently, people trampled each other trying to get out of the building.

It's called "being polite and treating people with respect". So swearing at a teacher is a sign of disrespect.

Some of your rights get taken away at school

by Anonymous 12 years ago

Except, when you're at school your rights don't matter anymore...

The law is that the GOVERNMENT can't punish you for exercising freedom of speech, but schools can do it as much as they want.

The first Amendment doesn't protect you under obscenity. Even though you won't get arrested for swearing at a teacher, you can get in as much trouble as the school sees fit.

They would be violating our rights if they used federal punishment. Detention is small beans. Also, it's "constitutional rights", not "human rights".

You lose most of your rights as soon as you walk into the school building.

We also have a right to bear arms, but school has a different set of rules. Plus, teachers are allowed to disciple any student that is disrespectful, rude, or disruptive. Your rights aren't taken away, silly.

School is a privilege. If you have a problem with how things work there, then don't go to school.

we're also entitled to the pursuit of happiness. If we get homework that we dont wanna do, then technically we dont hafta do it if it no doing it helps us in our pursuit of happiness

by Anonymous 12 years ago

Maybe you should start going to school and doing your homework because your spelling and grammar is atrocious

by Anonymous 12 years ago

haha wow i failed at typing....i'm usually a lot more coherent than that

by Anonymous 12 years ago

a kid in my class tried that and our teacher told us in canada their is no free speech thats only american

by Anonymous 12 years ago

also, if you are under 18 then your full constitutional rights haven't been given to you at all, in or out of school

by Anonymous 12 years ago

While you're in school, your rights are severely reduced compared to if you were anywhere else. That's just the way it is.

In the UK if you swear infront of an Officer they will warn you and if you repeatedly swear still you can be detained under a certain section, Breach of the Queens Peace. In schools you are a minor usually and therefore require someone to actually be looking after you so they can punish you for breaking the rules to be at that school.
