On the contrary, leaving the 'to' there makes the verb 'execute' an infinitive, which leaves the object 'innocent man' without a finite verb.
And I suppose the pretentious part is subjective, but I disagree.

It depends on the crime. If they were a serial murderer or rapist, I'd take the chance and execute them, but if they were accused of robbing a bank or something and had no criminal record, I'd be more inclined to set them free.
