I might be wrong, but I think a phoenix can be killed and it won't be reborn. It is only reborn if it dies from old age.

Harry came back to life because of the love thing, a phoenix regenerates itself, but nagini didn't have any such property. You could be right though; killing a phoenix might be permanent ,but in that case while sad, at least the horcrux would die too.

But we don't really know if a phoenix will regenerate after being murdered. We only know they regenerate after dying of old age. Who knows.

I think that it would be a horcrux until it was actually killed to the point that it wouldn't regenerate itself.
