It's more like saying: "It only happened if someone can prove it did." which, to an extent, kinda is the same as saying it's only sex if you get pregnant, because to anyone who wasn't involved, they'd have no way of knowing for a fact that it happened unless someone did get pregnant...

Depends if I ever knew it happened or not. If I somehow never found out that she had been killed, then I wouldn't mind, since I wouldn't know. I know that's beside the point, but still. I'd probably be insanely upset, if it happened in real life... But then, since the police would know about it and be actively looking for the killer, it wouldn't precisely count as not being caught. If the police are searching for you, life is not gonna be easy. I think OP meant slightly more minor crimes, like stealing from a sweet shop, or doing illegal drugs. If you're not caught in the sense that nobody ever knows the deed was done, then you can't exactly say it's entirely illegal... Especially since you wouldn't be hurting anyone in my examples. :P

It's still illegal. If somebody murdered another person and they evaded the police, then that person still committed a crime, but they just haven't been punished yet.
