A drunk person can't legally enter a contract, but it can be quite dicey to prove you were drunk at the time you signed the contract.

Consent, in this context, doesn't come into play, because them being "drunk" is why the sex was meaningless and no one is talking about consent. Come back when someone says "I was too drunk to make a decision".
