There shouldn't even be a penalty for possessing them in my opinion.

Call me heartless or mean, but I think cigarettes, alcohol, and drugs are natures way of thinning our population. We have no natural predators as far as animals go. Our population is soaring and nature needs a way to reduce our population. The only way nature could find is ourselves. It made us significantly smarter than any other animal on the planet, and therefore our superior intelligence makes us think to hard about things so we go and start wars. As far as cigarettes, drugs, and alcohol go, our addictions are our predators.
