In my school, if someone comes up to you and starts beating the crap out of you, if you hit back you get just as much of a punishment. You're supposed to sit there and take it until a teacher breaks it up.... It's dumb

So the idea that both sides get punished equally in a fight, regardless of the instigator, inspired you to write a post suggesting that the winner should ALWAYS be punished more severely, regardless of the instigator? What if the victim managed to turn it around and beat the shit out of his attacker? The attacker should be punished less?!

Well, yeah. Beating the shit out of them is unnecessary, and that's what this idea is intended to prevent - unnecessary force. More often than not, you can just knock 'em off to get away. Granted, there would obviously be other cases, but I feel like this would widen the scope to benefit more victims than the current rule.

I knew that's how you would counter. Okay, so say the victim didn't use excessive force, but was still the clear winner? I think it's unfair. How about this. The ONE WHO THREW THE FIRST PUNCH gets punished more severely. Sound good? I think so.

That's how it is at my school. My mom literally said, "Screw that! If someone hits you, beat the crap out of them and /I/ will handle the school." I mean honestly, what person would stop beating someone up just because a teacher says, "Stop! Stop!"?

At my school, if someone randomly came up to you and started beating the shit out of you but you just sat there and did nothing, you will be punished just as much as the one who started it. Basically you will be punished for being the victim.
