+77 If a person cannot be held responsible when they consent to having sex while drunk, how come they are held liable when they decide to drive while drunk? amirite?

"Because its not like the person you hit when your drunk says, oh they are drunk, maybe ill wait for a two way stop and drive in front of them. They don't really have a choice in the matter and are injured as a result of you being drunk. With sex, I suppose the sober person is supposed to understand the person is drunk and realized that their decision making capacity is compromised. If both parties are drunk, then its a great time to try anal." Seems legit.

Wait, why is a person not held responsible to their decision to have drunken sex?

by Anonymous 12 years ago

Because they are "under the influence" and "cannot control their judgement"

I think that's stupid. they should still be held responsible. & who says they aren't held responsible? Or are you just going offa what people claim after having drunken sex? lol.

I'm saying that they should be just as responsible as a drunk driver, however responsible that may be.

I agree (:

This is an interesting point, actually. A person who has sex while intoxicated cannot legally give their consent. So the government thinks they are not responsible or aware enough to decide to have sex or not, but somehow they have the judgment to decide that driving is a bad idea, and do it anyway? Weird.

Because driving drunk can kill other people.
