I don't know if this counts but a while ago a dead boy was sued because he was found dead on someones front lawn.

There was a case of some guy who broke into a house in Britain through the roof. The ceiling gave way, and he crashed to the floor, and successfully sued the family who owned the house for negligence.

You can sue anyone for anything. You just need proof and a good case... And convincing lawyer.
