+80 If pedophilia is liking to have sex with children, the offender shouldn't be labelled a pedophile if the victim looks (they do have tests to find your biological age), acts, and says he/she is of legal age because the offender is still attracted to their adult characteristics, not their child-like characteristics. It should still be statutory rape, however, amirite?

And isn't it weird how the 18 year old in a couple of 17 and 18 years of age is technically a pedophile?

by Anonymous 12 years ago

It's only pedophilia if the child is prepubescent. An 18 year old attracted to a 17 year old isn't really a pedophile.

Yeah that's what I'm saying. According to the law, you can be a pedophile for going after jailbait, which is by definition a minor to whom a non deviant adult would be attracted to sexually.

I don't know about the laws in Singapore, but here there can be a two year age difference, so 19 and 17 or 18 and 16 would be OK. Also, I think if a 15 year old look like she's 23 the guy shouldn't be charged for statutory rape, it's not like he's supposed to ask for ID first. He will be cause it's the law and it's the best way to do it cuz you can't make laws based off how someone looks, I just mean it's unfair he's put in the same class of men who are attracted young ass lookin kids.

Exactly. Plus, the law has to be like this, otherwise the system crumbles and descends into anarchy. The law works in such a way that you would just be charged according to whatever technically was happening, but the point of the court is that a judge/jury is given the opportunity to rule on whether or not it's really as the law claims it is. Many countries set the age of consent at 16, so the scenarios you're describing are not likely to ever occur, especially with ages so close.

16 and 14, 15 and 17, whatever. The ages have to be that close because the age waver is only two years, any more than that and the one who was overage would be in trouble. Even if they were just a little older they'd still have to go to jail, because you can't just be like "well he's only 2 years and a month older, we can let him off" because at what point is it not OK to bend the rule a little bit? It's unfortunate, a girl who is 13 could look like she's 18, tell the guys she's 18, trick him into breaking the law, and he'd get in trouble. But like you said, the law has to be like this other wise it would just fail.

Right. Sometimes there can be a degree of flexibility, for instance the deception you described could help the older guy if charged. it can't necessarily get them off the hook completely, but if you can prove you have been properly deceived, it can at least reduce the severity of what you did.

That depends on the laws in your state. Where I live a minor over the age of 16 is allowed to date anyone that is up to two years older than them and it not be considered statutory rape. If it weren't for that, I would technically be a pedophile since my girlfriend is 17 and I am 19 (we're barely legal).

I want to vote YYA but it wouldn't make sense.

Alright blockhead. You are officially the most logical person on amirite in the eyes of mchalla3.

Thank you :)

Pedophilia is attraction to prepubescent children not child rape or sexual activity with children or liking sexual activity with children. And statutory rape is a bullshit term meaning illegal, consensual sex. Actual rape doesn't have a qualifier in front of it. It's just rape.
