No, not always...   I'm sure the drink preparers would soon learn to leave room for the expansion of the melting hypothetical ice, by not filling the glass or cup to the top, much as wine or soft drink bottlers leave room for thermal expansion by not completely filling their bottles.   Or the consumer could avoid spillage simply by sipping the beverage faster than the volume increase of the melting ice.
