Who ever said that has never heard of laws. There are reasons I can't buy a nuke at Walmart. The pen is far and away infinitely more mighty than the sword, in fact it's not even close.

And why did they accept it? Because they already followed most of the now coming laws, as they were written in their religious beliefs. Those were coming from people writing down basic human decency, because it is in our nature.
Also the pen doesn't rule where it doesn't reach, but the sword equally doesn't penetrate the wall.
