No it's not. They have a superior property claim to them than you, just not superior to the store
Technically yes it is it's just like taking someone's spot that they're just about to claim in a parking lot. It's an asshole move but still legal

I believe there's an episode of "Impractical Jokers" where they see how many items they can take from someone's shopping cart without getting noticed xD
