Stealing characters can be (and generally is) copyright infringement. Not a judgement on fan fiction but a truth. Otherwise everyone would make a Harry Potter movie.

Fanfiction and fanart are legally considered unlicensed derivative works. It's just that most companies realize that banning fanart would piss off their fans, so they only go after people who actually attempt to sell bootlegs.

People mostly just hate on it because either: A) They think it's made by immature people who can't write to save their life, or B) They think it's all just porn.

Fanfiction is copyright infringement, but most Creators quietly approve of or tolerate it, creating a legal Grey area. Ideas can't be copyrighted but using the character and world rather than similar ones is infringement
