You do understand that you're arguing that replacing the word with a very paraphrased version of the definition of the word makes the opposite of said word have "bad grammar", right? It's almost like that's why they don't say "not not real". They say "nonfiction". In fact fiction, despite official definitions, almost exclusively refers to something fabricated like a story. A story that never actually happened but in fact is made up. Nonfiction tends to be the opposite of that. Biographies, history books, accounts of those telling life stories or the stories of events that actually happened. And you're worried about the fact that if you replace "fiction" with the crude definition of "not real" that the phrase "non not real" or "not not real" is stupid, despite the fact that this is why the words fiction and nonfiction exist. You're purposely just shoving a second "not" in there. Fiction is synonymous with "fake". Fake and not fake. By your logic "visible" means "not hidden from sight" so invisible must mean "not not hidden from sight" and therefore is stupid.

I think of it as more of a binary categorisation method in order to separate books based on their grounding in reality - because that category is by far the most salient when considering what you want to read. In which case, you'd need a diametric labelling system and fiction happens to be a concise word that describes a complex idea. Therefore nonfiction is most logically the other label.
