A lie is often times better then no answer at all. If you are trying to narrow things done and they lie, they are now trapped within that lie and thus, easier for you to find the truth.

I don't need to ask the general public know if they have functioning observation skills, their actions, or lack thereof will speak for them.

This is very much based on context and what the question is. The issue is that we can't ask every single thing that can be asked about a person. There are many things that it wouldn't even occur to people to ask, if nothing else. I would never ask "Are you a serial killer?" for example, and I also wouldn't expect to be held accountable for failing to ask if it turns out they are. For some things, yes, you're right. If it's something you know is important to you, "do you smoke?" for example, then yes, ask. I also don't expect the other person to tell me every single detail about themselves because they might not know what's important to me. For example, I wouldn't assume that a person would tell me they dye their hair a colour different to their natural colour if they have no reason to know if I care (which I don't, for the record, just using it as an example.) But if it's something that's reasonable to expect someone to care about, and it's not reasonable to expect them to know to ask, then yeah, the onus is kinda on the person to reveal that to their partner. There are some issues that may be in a grey area, but you do the best you can based on what you think is sensible, and you don't deliberately obscure things you think might be important to them because you don't want it to affect their decision about you. And some things (even if not everything) are blatant yet obscure enough that yes, the accountability is on the person who failed to reveal it, even if they weren't asked.
