The punishment for texting and driving. amirite?
by RiverSerious4 days ago
Or make it way more punishable for texting and driving. A small punishment like this is nothing compared to what they could cause.

This is more of an unconstitutional opinion.
by Anonymous3 days ago
Yea, it does feel like cruel and unusual punishment.

I was thinking more along the lines of no person shall be "deprived of life, liberty, or property, without due process of law..." which is part of the 5th amendment. It might be a 4th amendment search and seizure problem as well. They'd have to give you a hearing or maybe at least get a warrant signed by a judge before they can drop your phone.
by Anonymous3 days ago
Definitely a due process issue but even ignoring that, why not...just take the phone? Unless OP thinks that potentially destroying it doesn't just pose the exact same constitutional issues that confiscation would.

How is it cruel?
by Anonymous3 days ago
Have you ever watched your phone fall to the ground, not knowing if it'll break or not? That is cruel.

It's Texas, what do you expect?
by Odd_Consequence3 days ago
Indeed. Violates the 4th and 8th amendments at the least. Definitely shouldn't be implemented in any way shape or form. Does serve well enough for me to explain how much texting and driving pisses me off.

I'm with you. And all we got to do is get 2/3rds of the Senate, 2/3 of the House of Representatives, and 3/4ths of the States to agree and voila, we've got ourselves a 28th amendment that dropping cell phones onto pavement is a legitimate punishment for texting and driving.

We have this thing called the Constitution that would mean you have the right to defend yourself in court. So, no. I'm well aware a lot of the Constitution is under attack these days, and Texas in particular seems to think said Constitution is only for rich white dudes but, no. That's not how that works OP

We need to adopt some Singaporean justice lol

"I'm okay with authorities destroying private property if it gets people to comply." My my that's a slippery slope you're on there.

Hey man it was your statement, just with fewer words.

We have the best drivers in the world because jail

perhaps the insurance companies enacting .. if you crash or are ticketed while texting. we are going to double your insurance rates every time.. is it still if you drive drunk your car insurance does not cover everything in accidents.. i don't drink. but that is my choice after growing up and loosing so many friends to drunk driving.

Im glad in the areas of texas ive lived its seemed to be ages better than the late 2000's. These days i normally see texters (or scrollers) at red lights and not while actively driving.
by janelle693 days ago
It's almost a $600 fine for texting and driving where I live plus points off your license. I still see people do it all the time.
by OkCamp96183 days ago
I personally think it should be punished the same a DUI is.
by Anonymous3 days ago
Nah, they should just impound the phone and the car. Make the person find a ride and pay a big fine to get them back
by Anonymous3 days ago
If they did this we wouldn't have any doordash drivers and people would be afraid to use it in case of a emergency
by broderick673 days ago
I think we should have an aptitude test with this. Give a professional stunt driver a 100/100 in the test and you the average driver a 50/100. Anything higher than a 60/100, you can text and drive.

Narrow framed opinion. If people want to get distracted, they will get distracted, there is nothing they can do, there are another 10 ways to take your focus off the road, but those are not legally regulated
by Anonymous3 days ago
So your solution to all problems is to shrug and say it is what it is????
