I was thinking more along the lines of no person shall be "deprived of life, liberty, or property, without due process of law..." which is part of the 5th amendment. It might be a 4th amendment search and seizure problem as well. They'd have to give you a hearing or maybe at least get a warrant signed by a judge before they can drop your phone.

Definitely a due process issue but even ignoring that, why not...just take the phone? Unless OP thinks that potentially destroying it doesn't just pose the exact same constitutional issues that confiscation would.

Indeed. Violates the 4th and 8th amendments at the least. Definitely shouldn't be implemented in any way shape or form. Does serve well enough for me to explain how much texting and driving pisses me off.

I'm with you. And all we got to do is get 2/3rds of the Senate, 2/3 of the House of Representatives, and 3/4ths of the States to agree and voila, we've got ourselves a 28th amendment that dropping cell phones onto pavement is a legitimate punishment for texting and driving.

I'm well aware a lot of the Constitution is under attack these days, and Texas in particular seems to think said Constitution is only for rich white dudes but, no. That's not how that works OP

perhaps the insurance companies enacting .. if you crash or are ticketed while texting. we are going to double your insurance rates every time.. is it still if you drive drunk your car insurance does not cover everything in accidents.. i don't drink. but that is my choice after growing up and loosing so many friends to drunk driving.

Im glad in the areas of texas ive lived its seemed to be ages better than the late 2000's. These days i normally see texters (or scrollers) at red lights and not while actively driving.

It's almost a $600 fine for texting and driving where I live plus points off your license. I still see people do it all the time.

I think we should have an aptitude test with this. Give a professional stunt driver a 100/100 in the test and you the average driver a 50/100. Anything higher than a 60/100, you can text and drive.

Narrow framed opinion. If people want to get distracted, they will get distracted, there is nothing they can do, there are another 10 ways to take your focus off the road, but those are not legally regulated
