Kimmel was pulled (indefinitely. As of this moment, still has his job) directly because of a threat made by the FCC chair that they would go after ABC if they didn't punish Kimmel for his statement (which, let's be real, was not even that big of a deal of a statement). That's a direct and obvious violation of the 1st Amendment.

the feds own the airwaves and ABC was contractually obligated, per its licensing agreement, to follow the standards set by the FCC. If outlets like ABC or CBS don't like it, then they can create their own broadcast network or push to have airwaves privatized.

The FCC had less to do with it than people want to believe. the pressure to cut Kimmel loose was internal. the two largest broadcast affiliates put the network on notice that they would preempt the show indefinitely and not show it in their markets. This action forced NBC to act and nothing else. They even gave him the opportunity to apologize and retract the statement, which he steadfastly refused to do. Even the women on the View are smart enough to do that part of things to keep their jobs.
