That would be fine assuming they are consistently passing traffic in the lane to their right. Otherwise they would be using the lane incorrectly, it is the passing lane not the fast lane

As far as I am aware and with very quick research, there are no apparent laws in the U.S. that require you to move over simply because a driver is speeding (such as going 15 mph over the limit). Some areas only allow left lane if you are passing. If you are going 12mph over the speed limit, you implicitly qualify as passing under these laws and more likely you are likely in-fact passing someone. Also, I find it hypocritical you quote laws when the first person in this situation to be breaking a law is the speeder.

In California is is a ticket able offense to be slower than the flow of traffic in the left most lane. Know why? Because it is a passing lane. California code 21654. Get a clue.

Everyone has an opinion but the law is that the left lane is for passing and if you aren't passing, move back over. It is against the law to decide you are going fast enough and will now become the police of others. You aren't paid enough to do that and it's dangerous as well as illegal. Nobody should camp in the passing lane at any speed. Use it to overtake and then get back into the right lane when you're done. If you want to gamble on a speeding ticket at 12 over, you do you. But that's unrelated to using the left lane.

I agree assuming others are not doing 18 miles an hour over, in that case get over. I'm not sure where people are traveling that roads are not congested enough to leave an entire lane open but it's sure not like that around me. Every lane being used and it's still slow af.
